THERATALES OFFICIAL CONTEST RULES

GEM Staffing (“Sponsor”) THERATALES Essay Contest ("Contest") begins on 12:00AM 11/15/2010 and ends at 11:59PM CST on 08/15/2011 ("Contest Period").  GEM Staffing retains the right to extend deadlines as deemed appropriate.  HOW TO ENTER: Create an original essay about your own experiences with individuals you have encountered in your career as a therapist (patients, patient families, mentors, etc). Essay must be in English and must be 500 words or less. All entries must include the following: First and Last Names of therapist, Mailing Address, Telephone Number, and Email Address.  Entries missing any of the aforementioned information will be automatically disqualified.  Entries must be postmarked by 08/15/2011. Up to two (2) entries per therapist allowed, but each Essay entered must be different. Entrant must be the sole creator of the Essay. Essay may not have won a previous award, may not have been published previously, must not be obscene or indecent and the use of the Essay by GEM Staffing ("Sponsor") as outlined herein must not infringe upon any other person's rights. All entries become the property of Sponsor and none will be returned.  Send entries to: GEM Staffing, ATTN: THERATALES CONTEST, 5440 N. Cumberland Avenue Suite 101A, Chicago, IL  60656  ELIGIBILITY: This Contest is open to licensed PTs, PTAs, OTs, COTAs, who are legal residents of the 50 United States, the District of Columbia, and Puerto Rico, 18 years of age or older at the time of entry.  JUDGING: Entries will be evaluated and winners chosen by a panel of judges appointed by GEM Staffing. Decisions of judges are final. Winners will be notified by telephone or Email on 10/01/2011.  PRIZES: One (1) Grand Prize of USD $500 and Five (5) Runner-Up Prizes of USD $100.  No prize substitutions permitted.  Prizes must be claimed by 12/31/2011 or else prize will be forfeited in its entirety.  INTELLECTUAL PROPERTY: By registering for the contest and/or submitting an entry you agree explicitly that all components of your work and supporting statement are indeed original creations.  Any intellectual property infringement, misuse or plagiarism of another person's work in any form or state will result in immediate disqualification and forfeiture of eligibility to receive all awards, recognition and prizes.  You also agree to allow Gem Staffing to make public statements regarding any disqualifications and any grounds for disqualification.  GENERAL TERMS & CONDITIONS: By entering this Contest, all entrants agree to release, hold harmless and indemnify the Sponsor, its affiliates, subsidiaries, distributors, and each of their respective shareholders, directors, officers, employees or agencies from and against any and all liability whatsoever for any injuries, losses, harm, damage (including but not limited to property damage, personal injury and/or death), claims, actions, costs and expenses (including without limitation, all attorneys' fees and court costs) arising directly or indirectly from or in connection with any prize or resulting from participation in this Contest or from acceptance, possession or use/misuse of any prize or participation in any prize-related activity or use by Sponsor of the entry in any manner. Submission of a Contest entry will constitute and signify the entrant's agreement that the Sponsor and/or the Sponsor's assignees may use the entry, name, photograph, likeness and/or prize information for promotional purposes in commerce and in all media worldwide now known or hereinafter developed without time limitation and without further compensation, except where prohibited. Submission of a Contest entry grants Sponsor and its agents the right to publish, use, adapt, edit and/or modify the entry in any way, in commerce and in any and all media worldwide now known or hereinafter developed, without time limitation and without further consideration to the entrant. Submission of any entry further constitutes the entrant's consent to irrevocably assign and transfer to the Sponsor any and all rights, title and interest in and to the entry, including, without limitation, all intellectual property rights. Winners are solely responsible for any local, state, or federal taxes on prizes. Void where prohibited. Sponsor reserves the right, at its sole discretion to cancel, terminate, modify or suspend this Contest and determine the Winners from entries received prior to action taken, or as otherwise deemed fair and equitable by Sponsor. No more than the number of prizes stated in these Official Rules will be awarded.  LIMITATIONS OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU INDEMNIFY AND AGREE TO KEEP INDEMNIFIED GEM STAFFING AT ALL TIMES FROM AND AGAINST ANY LIABILITY, CLAIMS, DEMANDS, LOSSES, DAMAGES, COSTS AND EXPENSES RESULTING FROM ANY ACT, DEFAULT OR OMISSION BY YOU AND/OR A BREACH OF ANY WARRANTY BY YOU SET FORTH HEREIN. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU INDEMNIFY AND AGREE TO KEEP INDEMNIFIED GEM STAFFING AT ALL TIMES FROM AND AGAINST ANY LIABILITY, ACTIONS, CLAIMS, DEMANDS, LOSSES, DAMAGES, COSTS AND EXPENSES FOR OR IN RESPECT OF WHICH GEM STAFFING WILL OR MAY BECOME LIABLE BY REASON OF OR RELATED OR INCIDENTAL TO ANY ACT, DEFAULT OR OMISSION BY YOU UNDER THESE RULES INCLUDING WITHOUT LIMITATION RESULTING FROM OR IN RELATION TO ANY BREACH, NON-OBSERVANCE, ACT OR OMISSION WHETHER NEGLIGENT OR OTHERWISE, PURSUANT TO THESE RULES BY YOU. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE TO HOLD GEM STAFFING, ITS RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES AND ASSIGNS HARMLESS FOR ANY INJURY OR DAMAGE CAUSED OR CLAIMED TO BE CAUSED BY PARTICIPATION IN THE CONTEST AND/OR USE OR ACCEPTANCE OF ANY PRIZE WON.
